I think the unborn should have some degree of constitutional protection during the third trimester of pregnancy. The scope of that protection is subject to debate.

What about those not conceived yet, but who someone intends to conceive? Should each sperm or egg have it's representative? Birth is the most obvious and verifiable time to make a ruling.
