It all fell apart when Congress stopped asking ( and the Courts stopped requiring them to ask ) where in the Constitution is this act authorized.

They used to wink at each other and say authorized by the Interstate Commerce Clause. Now they've stopped even that. Federal power is now practically unchecked.

You cannot get around the argument that every vote should count equally in a national election. If you argue against that you are putting one above another. Whomever you choose to be more important you are unfair nomatter who it is.
