The courts will make their decision primarily on whether the inclusion of those votes will have a material impact on the Presidential election. They will care less what the SoS or anyone else has to say.

This means that the courts would completely bypass Florida law and go into uncharted waters on their own. I think it is highly unlikely.

As far as I know, no section of Florida law is under attack by either side to be unconstitutional, only the interpretation of it.
