Thanks for the many good posts you have contributed on this subject as well as others.

My own opinion:

Gore is coming to the realization that he is losing and is subtly shifting his efforts to ensure things are sufficiently chaotic to pave the way to the next election.

In short, before he leaves the vicinity of the Oval Office, he will be sure to leave a turd on the desk.

In the matter of the US Supreme Court. I'm halfway to agreeing with you, but I also think there's a good chance they'll hear the case, partially because there is so much controversy already, there will be much, much more if the Fla. Supreme Court overturns the lesser courts, and partially because they are part of the triangular balance of power in the US. The gravity of the situation calls for it, IMO, especially when the 3rd leg of that triangle may find itself in a position to influence the electoral process - and two votes there would be acting in their own interests.

Just my ignorant opinion.

Kodiak: Excellent exposition of the governing legal parameters of Judge Lewis' decision refusing to find as a matter of law that the Sec'y of State was arbitrary.

My concern is that the judge's decision (courageous for a Democrat) may not have involved any "finding of fact." A probably partisan Fl supreme court may take advantage of this. They can say that they have the sec'y of state's written decision and the written declarations from the 4 counties with justification for a delayed handcount. "We have everything Judge Lewis did" they say, thus we can make an "independent" evaluation of whether or not there was anything arbitrary.

I'm still worried.

BELGRADE-- Serbian president Vojislav Kostunica deployed more than 30,000
peacekeeping troops to the U.S. Tuesday, pledging full support to the
troubled North American nation as it struggles to establish democracy.
"We must do all we can to support free elections in America and allow
democracy to gain a foothold there," Kostunica said. "The U.S. is a major
player in the Western Hemisphere and its continued stability is vital to
Serbian interests in that region."

Kostunica urged Al Gore, the U.S. opposition-party leader who is refusing
to recognize the nation's Nov. 7 election results, to "let the democratic
process take its course."

"Mr. Gore needs to acknowledge the will of the people and concede that he
has lost this election," Kostunica said. "Until America's political
figures learn to respect the institutions that have been put in place, the
nation will never be a true democracy."

Serbian forces have been stationed throughout the U.S., with an emphasis on
certain trouble zones. Among them are Oregon, Florida, and eastern
Tennessee, where Gore set up headquarters in Bush territory. An additional
10,000 troops are expected to arrive in the capital city of Washington,
D.C. by Friday.

Though Kostunica has pledged to work with U.S. Leaders, he did not rule out
the possibility of economic sanctions if the crisis is not resolved soon.

"For democracy to take root and flourish, it must be planted in the rich
soil of liberty. And the cornerstone of liberty is elections free of
tampering or corruption," Kostunica said. "Should America prove itself
incapable of learning this lesson on its own, the international community
may be forced to take stronger measures."

Question. Does that mean the Atlanta based Fed Court of Appeals will refuse to hear the FL case even though it decides the outcome of a national not a state election and therefore may involve US Constitutional issues? TIA
