Dear James West: Your analysis is similar to mine when yesterday I was convinced that Judge Lewis would not be overturned. However, when the Supreme Court took it upon themselves to issue an order NOT EVEN REQUESTED by either party I was ASTOUNDED. I have never seen this before. Also, in reading what they said, it seems to me that they are going to allow any evidence anyone wants to bring into the court. I had always been under the assumption that the higher courts could only review the evidence presented in the lower court to see if they agreed with the lower courts finding of fact etc. There are so many STRANGE things going on here that I have now come to believe this Court very well may be intent on REWRITING THE LAW to favor Gore. Its INCREDIBLE but I dont see how it could be any other way. I hope that I am wrong. JDN

Dear James West: Sorry, I am picking on you to respond to as you seem to have a pretty good foundation in the law. Here is the latest as I understand currently which happened last night. Apparently nearly half of the overseas ballots were THROWN OUT, most were from Military Personell. Reason given for the most part is lack of Postal Date Stamp and sometimes for lack of witness. Fact: The head of the US NAVY postal service stated in writing that in the case of personnel on ships often the mail is NOT DATE STAMPED as they have to get it on the supply ship when available and may not have time to stamp it. Fact: The requirement for witnessed signature I understand is not clear on the ballot. (I have never voted absentee so I cant personally state this but this is what I have been told. Summary and Conclusion: It would appear on the face of it that the WILL OF THE PEOPLE must be determined but ONLY if it is the RIGHT PEOPLE with the RIGHT WILL. Sound familiar. Oh yes, it just AMAZES ME that one can look at a slightly indented (pregnant chad) ballot and by DIVINE RIGHT decide the will of the people, but that one cannot look at an absentee ballot lacking only a postmark THROUGH NO FAULT OF THE VOTER if stationed on a ship and feel that it is not a vote. Thats Florida Politics for you. JDN
