I agree that the allegedly confusing ballot provides no justification for the recount, as I see no way that looking at the ballot card is going to resolve that.

The justification for the manual count, as I understand it, is that the inherent error rate of the punch card ballot system exceeded the margin between the candidates. This can be seen by noting that when the machine recount was done, the margin changed by more than where it ended up. Apparently the secretary of state believed that there was sufficient reason for the manual recount in Volusia County, since she accepted those results. Thus, the only issue she had with the other three counties' manual counts was their missing of the deadline, judging by her actions. Whether the Florida Supreme Court will judge that to be a sufficient reason remains to be seen.
