Hi Carl,

1.) I admire your restraint.

2.) What do you make of the constitutional arguments being put forth by both parties? Seems to me if the FSC rules to overturn Harris's discretion, or some other inequitable(as viewed by either party) ruling with respect to counting, this will wind up at the the Supreme Court under those arguments. What grounds do you think they could use to reject the constitutional arguments?

I presume you mean that they aren't going to try and channel President Madison and Ponce DeLeon to devine how this would have been done by the founders. This is a widely acclaimed and respected bench.
