to follow precedent or pay much attention to the way the statutes are written.

The only reason that the case is at the supreme court is that the circumstance is unprecedented and the laws are unclear and in conflict. At this point I prefer to see what they do rather than speculate on what they will do. I have my opinions about what they should do, but opinions are like bellybuttons.
