The Court had jurisdiction over the case, and nothing in the law says it does not have inherent authority to enjoin, sua sponte, the Secretarty of State from acting (as she declared she would) where the pending controversy directly questioned her authority to act.

The statutory construction analysis of the Court is run-of-the-mill, well reasoned and principled. Isn't that what you Republicans want in a Supreme Court?

Do you teach your students to base their legal decision on what they have heard about the law? Go read the opinion.

Baker's comments this morning are almost as baseless as the arguments in the Republican briefs filed with the Fl. Sup. Ct. There's no "fiat", unfairness about the decision, and no federal question. Frivolous drivle, IMO.

More importantly, tell me what you've got out to drink over the holiday weekend. :)

As I said on my site last night. The heck with it, let Gore win and let people get what they deserve. We will see how many handouts there are when suddenly everyone desn't feel so rich anymore. I talked to my broker yesterday and many of the Mo Mo players were wiped out this spring. This down turn isn't as bad margin wise but there are a few. He had a huge one yesterday. Election wise, I could careless anymore. As I said, they get what they deserve. I hear Australia and the Caribean will be nice for the next 4 years. I will just put in for orders to go overseas. Unfortunately we have no bases in the Camens but the Azores and Guam aren't too bad and there is always England, Germany, Italy etc. -gggg-

Don - I checked the profunds site and they did away with many of thier short overseas funds but all the long funds are still in play.

As an outsider, I am astonished that anyone would even consider that a "dimpled" ballot should count as a valid vote. In a mature democracy that would just be a non-vote. But assuming that they are counted, since this is what Gore appears to need to win the election, would that then not violate the equal-protection clause under the U.S. constitution, since in all the other counties, these would not be counted? Hence would the Bush team then not have a valid case for the Supreme Court? Also, what are the chances that the Florida legislature decides by law what should be counted as a valid ballot?

<Back on topic> I am surprised how well the futures are keeping up this morning, since an open at these levels would give a big sell signal on NDX with a short-term target around 2550, the break-out point last October. I also think that that level would hold for the moment (in any case, Don says so).
