Although I am not that knowledgeable about legal matters, I
propose that the Executive Branch (assuming they can think
strategy) may be better off not talking about this at all.

They should wait until the counts are in and the results
known. If the Gore team suddenly "finds" enough votes by
counting any scratch or whatever as a vote, then and only
then should they state publicly what they may be examining
privately as an alternative. This alternative should be
investigated privately.
