If the US Supreme Court finds that the Florida Supreme court usurped the power of the legislature, The US Supreme Court will not rule on the question of whether the Florida Supreme Court correctly construed and applied the Florida law. Such a holding would violate states rights. The court has always left it up to the state court to decide and interpret state law. The only question for the US Supreme court is whether the Florida law, as construed and applied by the Florida Court, violates the US Constitution? If it does, then the court must fashion a remedy.
