why would the Supremes take on a situation voluntarily just to "legitimize" the election? The obvious answer is to help heal the division in the country and provide some clarification on election procedures. The other answer would be to hold the Florida procedure unconstitutional and sent it back for a recount of the entire state. This remains a very real possibility. It only takes 5 justices to vote for a review. By taking the case, the court is saying nothing about the outcome.
