Wouldn't you agree that if Gore was to overtake Bush's lead in Florida based on votes added to his total from ballots that were originally counted as 'undervotes' by machines in his selective, and legal, recount of those counties that he would therefore have won the presidency on a legal technicality?

In simpler words, is it not unfair (even if legal) to allow such a small percentage of the invalid votes in this country (an even in FL) to be recounted, and then decide the election?
