Both the house and the senate must reject the electors or they are valid. Like it or not, the US constitution specifically spells out the remedy for a situation such at this which is a statistical tie. The remedy is not to let the courts decide how best to count votes, chad, and the like. The constitutional remedy is that they state legislature is tasked with picking the electorates. Thus, Bush will win Fla. If the residents of Fla do not like the outcome, they will toss the legislature at the next election. And if the overall population is unhappy with the results, they will direct the Electorial College to toss Bush. Gore can not win even though he has no qualms about trampling the constitution trying. Unfortunately, so few of the general population even understand the constitution or the genius of our founding fathers that it is in serious jeopardy. This country is not great because of the good will and general congeniality of its people. US history speaks volumes against that silly notion. THis country is great because our founding fathers considered man to be flawed and thus in need of restraint. The US Govt is the only govt in the world that is based on the premise that man, left to his own, can not be trusted. The constitution, and the balance of power it proscribes, is specifically designed to address the basic tendency of man to act selfishly. Therein lies the greatness our our country. Through our constitution, we limit the ability of tyrants to dominate the country. The best that they can hope for is 4-8 years of rule. And through the state directed Electorial College, we make it very difficult for a leader to control and manipulate the Presidential election process. This is pure genius. It is disturbing to hear cries for disbanding the Electorial system, when it is one great pillar of strength of our nation.
