Bar Complaint Filed Against Boies

The press has yet to question Gore lawyer David Boies about the Chicago Tribune's bombshell report last week revealing that he filed a false affidavit with Florida's Supreme Court, which gave the court precedent for allowing the counting of dimpled ballots.

But lawyers know that what Boies did could land him in hot water. One such member of the legal profession is NewsMax.com's Jack Thompson, who on Wednesday filed the following complaint with several legal disciplinary committees in the state of New York:

Re: Formal Bar Complaint Against Mr. David Boies

Sir/Madam:

This constitutes my formal bar complaint/grievance filed against Mr. David Boies. His primary offices are located in Armonk, New York. It is unclear as to which of the above three offices has jurisdiction over this matter, so I send it to all three. Please apprise me as to whom additional correspondence and filings in this regard should be sent.

Specifically, as the lead attorney for the presidential campaign of Vice President Gore, Mr. Boies incorrectly and prejudicially misrepresented to the Florida Supreme Court the ruling of the Illinois Supreme Court the case styled Pullen v. Milligan, 561 NE2D 585 (Ill 1990). Additionally, Mr. Boies submitted to our state's highest court a false affidavit from a participant in that same case.

The November 22, 2000, opinion of the Florida Supreme Court reveals that it relied, to its detriment, on the false representations of Mr. Boies.

There has been extensive national media coverage of Mr. Boies' misrepresentations in these regards. I enclose a copy of a prominent article in the Chicago Tribune which is just a small portion of that coverage (Exhibit A hereto). Categorical assertions on television networks that Mr. Boies played fast and footloose with the truth have been made by objective journalists.

I contacted Mr. Boies and his office directly and asked him to go back to the Florida Supreme Court, as he is required to do under any state's ethics code, in order to correct what I would generously call an "error." He refuses to do so.

This failure constitutes, in my opinion, an ethics breach by Mr. Boies so severe that New York's Appellate Division must address it pursuant to my and other grievances/complaints that may be filed against Mr. Boies.

Because each state's disciplinary procedures are different, this filing may be deficient in some technical regard. Therefore, please know that I am prepared to remedy any such defects and submit affidavits, for example, from myself and others should you need them.

This alleged misconduct by Mr. Boies is just the type of "win at any cost" behavior of lawyers that has so damaged the regard in which the public holds lawyers.

If you fail to act on this matter, you will lower that regard further.

Amazing. That is utterly duplicitous.

I'm impressed though with your ability to remain in absolute denial.

You may wish to be a bit more careful addressing dignity and practicing it.
Someone other than myself may actually read some of your posts.
