You're right. Bush did. But the US SC didn't bother with this, because the FL SC had asked Bush if he wanted a manual recount and Bush said no. Thus, there was no 14th amendment issue.

The US Constitution gives power to the Electoral, not exactly to the "will of the people", so this is where FL SC messed up. Blah. But the FL Constitution gives precedent to the "will of the people", so this was where the disconnect seemed to occur. The FL laws seem to conflict with the US Constitution. Translated: it seems to me the FL SC ruling was correct when measured by FL law, but incorrect when measured by the US Constitution.
