The FL laws seem to conflict with the US Constitution. Translated: it seems to me the FL SC ruling was correct when measured by FL law, but incorrect when measured by the US Constitution.


And (I presume) US const. supercedes FL const.

But the US SC didn't bother with this, because the FL SC had asked Bush if he wanted a manual recount and Bush said no. Thus, there was no 14th amendment issue.

You seem to be making huge laps of logic.

First of all, you are assuming that FL SC has a power to grant a state manual recount. It does not. Second of all, the answer of Bush team is irrelevant.

Suppose a lunatic on the street stops me and offers me the Brooklyn Bridge. I say "No thanks". The reason I don't have the Brooklyn Bridge right now is not because I said "no, thanks", but because the lunatic could never deliver it to me.

As far as your statement that there is no 14th amendment issue, that's a complete leap of logic, which you didn't back up. In fact, the issue is in the US appeals court. I don't know what the ultimate outcome will be, but if Bush loses the case, it will have nothing to do with them saying "no, thanks" to FL SC.

I think I posted it here earlier, the correct answer of Bush's legal team should have been: "Do whatever you want. If you want to order statewide hand count, be my guess. But see you at the US SC".
