Except that there was no decison--only what is known as a "remand." It's a draw.

e-bill, not only did the S.Ct give the Fl.S.Ct. a "do over", they Court also refused to rule on whether a Federal Statutory of Constitutional issue was presented by Bush. This is a loss for Bush as the Federal Question will never be decided upon by the U.S. S.Ct., so Bush's petition has basically been tossed in the garbage assuming the Fl. Court can come up with a reason for the original ruling based on Florida Law. I guarantee you they will.

Not to mention the fact that it was an unsigned per curiam decision so we have no idea how many justices were in favor of issuing it. My guess is it was a compromise that allowed the integrity of the State Court system to be restored while not calling into question the S.Ct's political leanings. It achieves the goals I said the Court was trying to achieve.

This is a major set back for Bush no matter how he tries to spin it.
