Yes, the net effect is: we don't understand--tell us more about your reasoning. They decided not to decide. The FSC will now reaffirm, more strongly than before.

The KEY is the words NOT INCONSISTENT. That is a hint that they must change their ruling IMHO. Higher level courts OFTEN remand cases back to the lower court to review their ruling. IMHO it means change it yourself or we will. JDN
