This is not a liberal or conservative isuue. A remand is a non-decision--they give jurisdiction back to the FSC, which now reaffirms its decision. A vacatur, as this is known, has no impact as it is followed 99.9% of the time by reinstitution of the original opinion.

Bush expected a reversal, which this is not.

When the FLSC ruled, was that spun as a MAJOR victory for GORE? Of course it was. In fact we are told that Gore had been willing to concede if the FLSC ruled against him.

Now the SCOTUS said FLSC screwed up. How could it be anything BUT a defeat for Gore?
