If they rule differently both rulings would be valid in their respective counties until changed on appeal. One assumes that each losing party would appeal, in which the Appeals Court or State Supreme Court would presumably consolidate the cases and decide which approach was correct. Those courts are unlikely to allow vastly disparate remedies to stand, though they could do so -- remedies are discretionary with the court, so in theory vastly different remedies would not be illegal, and both remedies could be allowed to stand.

If the courts rule differently on questions of law, that's something for the appellate courts, which review decisions about the law "de novo," without deferring to the trier of fact. They do defer to the trier of fact on issues of fact.

The factual issues in Seminole and Martin are not completely identical. On one occasion a member of the Republican party was allowed to take some of the faulty requests for absentee ballots out of the Elections Board office overnight so he could try calling people at home after they got off work, to get info that he needed. So naturally this is considered criminal by the Democrats.

At any rate, I fully expect Judge Clark to rule in favor of Gore, due to the questions she is asking during closing argument. I find it hard to believe that she will throw out 15,000 ballots, but who knows?

Last night I came to the conclusion that if she does, I hope Gore becomes President. I really do. It may well be exactly what we deserve as a nation. Everything in this election has gone completely along party lines. It's disgusting. Justice is supposed to be blind. I guess that's one of those stupid things they tell us when we are children to keep us in line.
