Anyone who represents that the SC taking this case resolves the turmoil is at best being overly optimistic and more likely dishonest. Even if this does increase the probability that W get to be president, which is not necessarily the case, if the final opinion is split and the dissent as articulate as the dissent against the stay is, I don't think that it can fail to raise significant issues in the minds of many Americans of the extent to which we are truly one nation under law. Regardless on how this proceeds we as a country on going to be on very thin ice at least until the electoral process is confirmed by the US Legislature. The assault on the rule of law which this process has spawned (I thought Mr. Bakers comments about the Florida Supreme Court where especially inappropriate and poorly chosen, one would have expected that a former Sec. of State could have expressed disagreement with one of the State Supreme Courts in a manner that was more respectful of both their position and the importance of their credibility going forward), the extent to which the judiciary is very political and partisan which these cases are clearly demonstrating, and the degree of political animosity and rancor which are being engendered will have a severe debilitating effect on our government, our country, and invariably the economy which is so much the focus of both. Considerable damage has been done, and there is little reason to expect that still more will not be done before this is over. If anyone contends that this is good for the financial markets they are truly deluded. It is one thing to try to stage a rally in the face of bleak economic news, but to do so now will undermine the judgement and legitimacy of this countries economic leaders and capital markets at the same time that the legitimacy of our government is already being drawn into question.
