Actually they WOULD BE appealing to the USSC..

The inherent problem in this whole election debacle in Florida is the ENTIRE LACK of standards as to what qualifies as a legitimate vote.

The FLSC failed to elaborate as to what the standard should be in this current recount, although they have ordered a manual recount in counties other than the original three where all the confusion reigned.

And most importantly, these standards for identifying valid votes were non-existent before the election and had to be "created" post-facto to November 7th.

That's why the USSC will put a halt to this whole mess. They know that the FLSC has no right to order a remedy without explicitly stating the parameters involved in carrying out that order.

Until the Florida Supreme Court changed the law it was not possible. The original time the legislature had prescribed was 7 days. Gore din't first make his "offer" until after that.
