Skeets, I'm thinking that the hand-recount would be IN PLACE of machine counting due to an obstruction -- ballots contaminated during election night, say (flood or earthquake in Seattle area). Actually, I should have said hand COUNT in that case. But if a recount was ordered and in the meantime the ballots were contaminated, then you are right, there could always be a question if any could not be recovered. In that case, the Sec. of State should disallow the count for which damage was "permanent" to 1 or more ballots (maybe they burned up) and let the prior count stand. That, of course, still leaves room for the loser to feel burned.
