You are wrong. In the first few decades of our country the State Legislature did vote for the Electors directly. I believe it continued up to the mid 1800's. The legislature has the power. There was federal law added later, not constitutional, that allowed for direct elections. The December 12th date comes from that law. That is why the Legislature is free from the 13th on to vote directly.

This attempt will surely result in another trip to the USSC. While it sometimes astounds (Roe v. Wade, for example), I think it is going to have a problem with this.
And I'm sure one Democrat in each house of Congress will step forward to challenge it there.

This is going to be a tough sale. As it should be.
