Primarily they were illegal because they got through the multiple layers of defenses set up by the democraps to prevent such an event. Further, they were probably Bush votes.

take a look at salon.com - some votes were faxed in, many had never requested a absentee ballot, and others were mailed after the 7th

Salon saying bush would be up by only 28 votes.
