It seems however that most American prefer the court to decide than the Congress.

At least Congress is setup for political fights. The son of Justice Scalia was granted a high paying law job on election day, and the republicans then hired the firm for big bucks. The Supreme Court is not prepared to play in this arena and survive as an institution.
