The FTC decided otherwise, arguing equipment manufacturers and other companies can join the group at will, and royalties are set at a maximum of 5%.

If the Japanese FTC has decided otherwise, they will have completely overturned the entire idea of IPR....

Why do you think Japan FTC or 3GPP have a right to cut QCOM's IPR under their own rules while those companies already agreed to pay QCOM that assumed 5% rate? US will certainly come into play.

However the delay in deploying WCDMA will hurt QCOM in the short term while QCOM's IPR's positions will get less valued as time goes by.
