QCOM cannot be compelled to join in the WCDMA IP pool. The fact that all of the other players are willing to join in a pool and share a 5% royalty is evidence that they don't have strong / valuable IPR. It seems to me that this is an admission that QCOM holds the essential IP. Even with a 5% pool plus QCOMs royalty the total royalty payments for WCDMA will be much less than what exists now for GSM.
