From MarketWatch....

"ACTV sues Disney
--7:53 am - By Steve Gelsi
ACTV (IATV: news, msgs) said Wednesday it's commencing in New York federal court a patent infringement lawsuit against The Walt Disney Company (DIS: news, msgs) and its units ABC and ESPN. The suit alleges that the Enhanced TV or ETV system offered by ABC and ESPN in connection with their broadcast of ABC's "Monday Night Football" and "Who Wants to Be a Millionaire" and ESPN's "Sunday Night Football" infringes on three ACTV patents. ACTV, among other relief, is seeking a permanent injunction and monetary damages."

It's all on the line now. I hate to think what will happen if we don't win this one. Let's just hope that the reason this hasn't been done sooner is that Samuels has been deligent in his fact gathering.
