Yes, he would not have issued the stay, and would have relied upon others to settle the equity issue. However, as things stood, he acknowledges the equity issue, and says the correct remedy would be to remand with instructions. 7 justices agreed that there was an equity issue, but then disagreed on remedy. That is why all the news outlets and all their legal commentators reported it as they did: 7-2 on the standards issue, 5-4 on the suspending the count.
