I've never argued for Al Gore's particular tactics, just the rightness of a careful count of all legal votes in this election, so please don't change the subject.

Ballots in the undervote and overvote where the voter's intent is clear are legal votes; there are many precedent court cases that say so. (Your position that you should count by machine alone unless you can prove a breakdown is consistent, but has not generally been followed by the court rulings in contested elections) Nor did the Supreme Court rule here that hand counts are illegal.

In a recount fight, the loser tries to find more votes and the winner tries to keep them out. If the elections officials had included all the legal votes in the first count or the automatic recount, Al Gore's position would have been hopeless, assuming he was still the loser in this case -- there would have been no more legal votes for him to find, selectively or otherwise. That is why I say the elections officials messed up by not manually counting the undervote and overvote.

For an illustration of Voting Machine error rates, go the Miami Herald site; click on The Florida Election, then click Voting Machine Graphic. Central optical scan counties rejected 5% of ballots overall; 16% in majority-black precincts. So you're right, 15% was too high; I misread it the first time. Still way too high.

I say bad ballot design was at fault because I just read that many of these central OpScan counties listed the presidential candidates, then at the end said
"Write In Candidate's Name: __________________"
Many first-time voters took the instruction literally, and wrote in the name of the candidate they had just voted for. Their votes were for the most part tossed as overvotes.

How many of Supreme Court 7 do I find political? All 7, especially the 5 who "fixed" the recount by stopping it.

Srex - Great post! Of course Nadine is still throwing everything she can think of against the wall in hope some of it will stick. That is why I refuse to respond to her any longer.

Interesting that these dems are still all over K. Harris and still not a one peep concerning the dem operatives who so abysmally botched the election in Miami-Dade, Broward, Palm Beach counties. Fact is, this is the first time the dems ever wanted an honest count in those counties so they are somewhat flumuxed now as to what to do.
