In any settlement situation time pressure and available money to throw at the case are the two great elements definng the relative positions of the parties (assuming, of course, that the facts and the law are not so dead on for one party over another that these two become irrelevant).

Even if Infineon believes in its case, it now has to face the fact that there is a good deal of uncertainty involved. Time pressure is now increasing daily. The court date is just around the corner. Rambus has already made it clear it will "bet the ranch" on defending its patents, so the relative size of the companies in this fight won't help Infineon.

Time for a settlement. Put the sabres back in the scabbards and get on with business. Infineon's lawyers must be telling senior management the very real risk of a total loss here - that is part of their job. Will management listen?
