every now and again I find an argument that sways my views. You have just provided one.

I have always been against the hate crime laws because it tended to have a bias for the punishment based on the victim's profile. Didn't seem like an even application of the law.

But as you have presented it, it makes total sense to me since not only does the victim of the crime get harmed, but all people who fit that profile are oppressed through the threat of violence.

Thank you for articulating that so well.

Why do people not get the difference?

Should I infer from the context of your response that you are in favor of separate laws for hate crimes? If so, what is your rationale?

Threaten often enough to beat up faggots, and gays in your area will keep to themselves, because they are outnumbered. That's the use of violence to control. That's what hate crime legislation is about.

If the threat or the actual actions (beating people up, killing them whatever) is severe enough to deserve punishment then it should be punsihed. If I kill you then send me away (or to the chair) for murder. If I rob you or beat you I should face stiff penaltees. It doesn't have to be a hate crime, if I just want your money my actions are just as bad. If you have tough laws in place against people who extort, and steal, and beat, and kill and you enforce those laws then you don't need hate crimes laws.
