If JDS did not foresee the market downturn, and they are certainly as "connected" as anyone, how can they blame NT for not "seeing" it?

And if their JDS's DD did "see" the downturn, should I be talking to my lawyer too for them not guiding lower in their most recent CC?

Good rule: Don't make the attorneys rich at foolish expense.

When there is a real "war" to fight, then go all out, but until then, diplomacy and compromise, and all hands to the oars.

Remember bandwidth requirements will double every 9 months...

I think JDSU was too eager for the deal to close, thus taking a chance on some of the contractual details that could've (and should've) included. One of such could be a stock price collar, like what CIEN and TLAB had in their ill-fated merger attempt.
