It wouldn't be illegal in any way. It would be in keeping with how he sees the situation. After all, there would be a bulletin right if there were any material change in his outlook? No bulletin, he's still calling for a 90% pop right? Why would it be illegal to announce his views on his highly-opinionated radio program?

Should he be preaching speculation in the NAS100 in his newsletter but cash on the radio? Should he start making fun of those in the gambling sector of the NAS in public while advising subscribers to get into that sector in private?

I don't see how subscribers could be in any worse shape by his discussing his expectations about the NAS100 on the radio.

Instead of trying to get him to give trading advice on the radio, people should be trying to get him to stop giving it in the newsletter.

True, but I think people tried on his boards but he shut them down. I still like the sledgehammer approach: off the radio.

Also, the point about the trade on the radio is more in the interest of full disclosure and honesty IMO.
