<font color=red>The Case of the Not So Invisible Hand

We will skip the opening argument and the chronology of events, as almost everyone who has read these threads over the past week is familiar with them. In fact, we appear to be the ones most in the dark about the origins of this week’s controversy and were caught in the blast radius at ground zero.

We proceed directly to evidence. On Saturday, March 17, 2001, Teresa Lo send out an email message to her friends. It is self-explanatory, and now we enter into evidence, as Exhibit “A”:

From: "Teresa Lo"
Subject: Join the Revolution!

I am writing to let you know that we have changed the format of the
TopTick SquawkBox to that of a by-donation Trader's Club:

toptick.org

As many of you know, I have been a member of Silicon Investor for several years and have my own thread:

Subject 36945

Recently there has been upheaval at SI. To make a long story short, due to flagrant violations by other members, SI has had to enforce their Terms of Use statement to the letter. While others who have commercial web sites are fighting the application of stated policy, we have decided to take the ultimate step and made our chat room into a club that members join by donation only, as a challenge to the others.

If you wish to be part of the Revolution, please feel free to join us at your convenience. As always, we are a little different than the rest.

Teresa

We enter into evidence, Exhibit “B”, posts made to Options Jerry’s thread by SI member “trader_joe”, shortly after it was launched to support his new chat room.

We enter into evidence, Exhibit “D”, OptionsJerry’s thread, Come trade the markets with "Da Room Dat Rocks Crew", noting that it was launched on January 21, 2001.

Subject 50660

We note that our chat room, TopTick SquawkBox, was launched on March 12, 2001. We enter into evidence, Exhibit “E”, Jenna’s post on the brewing controversy concerning “advertising on SI”, made under her own user name on March 14:

Message 15498735

We note that trader_joe and another new SI user, donald_d begin posting on this topic, and somehow, Teresa Lo is drawn into the mix. The posts are too numerous to list, but we enter into evidence, Exhibit “F”, some of the people who are involved:

Member 8986003

We enter into evidence, Exhibit “G”, a list of messages containing the words “Teresa Lo” to document the chain of controversy concerning advertising over the past week:

UNDER RECONSTRUCTION Bookmarkers, Gemmers, Posters, Lurkers, we will keep you informed where we will be for the intraday updates, custom charting, and educational articles, analysis. As for now will move temporarily to a more fully featured bulletin board. Please e-mail me at jenna7@adelphia.net if you want to be included in a e-mail mailing list so that we might inform you.

UPDATE: we have hundreds of e-mail requests, we can handle up to 2 or 3,000 so keep them coming in. We will be posting back on SI when we can. You see MG is not allowed to post any links. We added them innocently as we saw new links put up onanother thread called PROFESSIONAL services. I sent 3 e-mails asking if the restraints were lifted. Getting no answer I assume they were. We posted Professional service and we got banned. The other thread is now continuing that link to a 'for pay' site but is allowed under a codicil I still haven't located. No doubt, I'll find the codicil allowing one to advertise while the other can't. We were perfectly happy to take off all our links and only replaced them after that other thread added TWO new links, and is STILL posting links at this moment. This is amusing since we don't need the advertising, but it seems the others do. And simply if you can't take the heat then move away from the fire. Fortunately, I can take the heat.

jenna,
Market Gems on SI

We enter as Exhibit “M”, an email received by Teresa Lo, from a certain “John Campion”, dated Fri, 16 Mar 2001 22:59:08. This time stamp is incorrect on the yahoo mail server. We note that the IP address of record for the originator of this email message is [24.49.20.53]. In this email, there is only a link to a web site, which, at the very bottom, shows a screen capture of an SI private message sent to trader_joe by Teresa Lo, during his January attack on OptionsJerry. In return, Teresa Lo sent “John Campion” a link to Exhibit “H”, which, for the record, was ottographs.com

Ms. lo

We see no connection. The fact that you are obviously desperate, and gotten into the trenches by cheapening what is no doubt a valid service and offering it for free shows you are very, very thin skinned. You will now never be able to take that $200 a month. unless you leave SI because the posts have been cut and pasted and that locks you into your word. Obviously what you have is not worth more than $0.50 a week.

I did receive a pm saying you were strong armed by Jerry and called at night numerous times to pump his and your forum by showing up and not even doing a thing. pump and bait. This release of confidential information (we still have the e-mail and will use them) to a virtual stranger..will not go over that well, me thinks. Your total fear, greed, consummate lack of professionalism is showing. Don't unravel, dear, you should be able to withstand those detractors on SI.. Even if they print a pm you might have sent, you should stand above all this.

john campion

We enter into evidence, Exhibit “O”, a trace of IP [24.49.20.53]. It shows that the email messages from John Campion, Exhibits “M” and “N”, originated from a user at adelphia.net. We note that Jenna’s email address, Exhibit “L” is jenna7@adelphia.net:

look 24.49.20.53 ... found
Name : wb1d-4920-53.pbc.adelphia.net (.NET | Network)
Address : 24.49.20.53

Screen Shot: ottographs.com

Conclusion:

While all the evidence is circumstantial, we may proceed to form some conclusions.

By way of background information, Jerry Olson was a moderator at Pristine.com, in Jenna’s Market Gems chat room. During the fall of 2000, Jerry and Jenna parted ways, and Jerry eventually went to Teresa Lo’s site, where he hosted a chat room for a few months. Teresa and Jerry parted ways in January 2001, and since then Jerry has had his own thread on SI and his own chat room. Teresa Lo had retired from real time chat in April 2000, and was teaching a trading class for a few days a month during the balance of the year. She launched her own chat room on March 12, 2001.

It is interesting to note that the attacks on Jerry and Teresa began shortly after they launched competing services to Jenna’s chat room at Pristine. For the record, in October 2000, Teresa was invited to join Pristine and declined. Shortly thereafter, IntelligentSpeculator.com was subject to a series of Distributed Denial of Service (DDOS) attacks that lasted several months. As IntelligentSpeculator.com was hosted by a small local ISP, the site was often crippled, and led to the eventual move to the new scaled-down version of the site, which is now hosted by Yahoo. The DDOS attacks may or may not be related to the case on hand.

We fast-forward to this week’s events. We have reported this to SI Administration, and will let the people decide and draw their own conclusions.

We will no longer digress from our real work and enjoyment of the fruits of our labour. This will be the last post on this subject, as from our standpoint, it is an open and shut case.
