Wrongo, Carl. One reason Rambus may not have claimed a violatin of the NDA is that they may have sworn statements from the defendents indicating they did no such thing...they developed their technology completely outside any peeking. If the depos go the way I think they will, Rambus will petition the court to expand its claims, or will file new claims under entirely new causes of action, which it may well be able to do.

Carl, during the deposition of Infineon people, they claimed they knew nothing or very little about Rambus, no ground to even chase the NDA type accusations, with these documents the story changes 180 degrees, there is nothing to prevent Rambus from amending their suit against Infineon if new evidence come to the fore, or even initiate a completely new case.
