John, I have always been a believer that this case just cries out for settlement. I think the seven days prior to April 14 are the "prime settlement time", as counsel and senior management will be finalizing their strategies and taking hard looks at the strengths and weaknesses of the other guy's case. Right there is where the lump in the gut gets pretty big. In large part here we are dealing with "old news" (circa 1992) as far as events and memories, we have missing documents, we have elaborate and intricate law surrounding patent rights, we have an industry which is really suffering to turn a profit right now. We have senior management, shareholders, the press, the street all watching and ready to punish or reward (mainly punish) the "loser".

Best of all, I sense we have a judge here who is bright enough, interested enough and in control enough to push for a deal. All the signs you point to indicate the parties are trying to defuse the rhetoric a little and get the issues framed for discussion. Now, how can a deal be structured where both sides can claim some form of victory?
