OT: John,

I'd further distinguish between "gathering intelligence" and "intercepting private communications". For me to do the latter in most, if not all, of North America without a search warrant is an unlawful activity. We tend to value our own privacy highly, but have little regard for that of others. I would regard spying as the gathering of information without the implicit or explicit concent of those being "spied upon". Thus I called the E3P a spy plane. It's also shorter than calling it an Intelligence Gathering Plane. <g>

It seems to me that either party could have avoided this incident and the loss of a life. Neither is blameless. It just doesn't seem to make much sense to unnecessarily prolong the incident.
