abby and bagodonuts will burn in hell for their part in this, but legal action against them would be fairly difficult. their clients all sign an arbitration agmrt when they open an acct (just like with any broker), and i'm not aware of any other legal theory to go after them other than from a client/broker relationship. unless you tried some sort of selff dealing theory... not sure. nobody has ever gone after those guys before and been successful under current law, but i'm not real up on it as i am not practicing any more....
