FCC Seeks Higher Baby Bell Fines
To Control Anticompetitive Behavior

WASHINGTON -- The head of the Federal Communications
Commission has asked Congress for authority to levy much larger fines
against Baby Bells that engage in anticompetitive behavior aimed at
keeping control of local phone service.

In a letter to lawmakers, Chairman Michael Powell complained that the
FCC can fine the Bells only $1.2 million per violation, a sum he called
"insufficient," given the companies' vast resources. Mr. Powell asked
lawmakers to increase the penalty to $10 million, and to give the agency
more than a year to investigate allegations of anticompetitive behavior.

"In some cases, competitive local-exchange
carriers may have been stymied by practices of
incumbent local-exchange carriers that appear
designed to slow the development of local
competition," Mr. Powell wrote.
