Jury finds Rambus committed fraud

RICHMOND, Va. -- A jury today ruled that Rambus Inc. had committed fraud and awarded Infineon Technologies AG $3.5 million in punitive damages.

The same jury found that Rambus had not committed a violation of the RICO racketeering act, however.

The verdict came in the antitrust suit filed by Rambus against Infineon in Federal District Court. Last week, Judge Robert Payne ruled that Infineon had not violated any Rambus patents.

Infineon today told Judge Payne that it would later file a motion asking the court to declare that the Rambus patents are uneforceable regarding Infineon.

Today's verdict stemmed from Rambus's alleged failure to disclose to the industry JEDEC committee that it had applied for synchronous memory patents, even while Rambus was participating in the drafting of the open SDRAM standard.

Judge Payne told the jury Tuesday if it determined that Rambus committed an actual fraud, it had the option of awarding punitive damages against the firm.

The actual amount that Rambus may eventually pay could be reduced to as little as $350,000 however, due to Virginia laws capping punitive damages.
