One thing Senate liberals and conservatives probably agree on (though not the porkers) is that excessive horse-trading on judicial appointments is unseemly. (Occasional back-room horse-trading appears not to bother either of them.) The Bush administration will appoint whom they appoint and the fight will go forward. It's a question of whether the seats will or will not be filled.

Whether liberals or conservatives might ultimately prevail overwhelmingly enough to break permanent judicial stalemates is a question Senators have studiously avoided in at least the post-war era. I don't think that Mutual-Assured-Destruction situation will last much longer, and I also think that it would be an excellent responsibility for our government to re-confer back to the electorate, where it should have always been...
