If both parties have agreed in advance that they don't want kids out of the relationship, but their birth control fails, isn't the right thing for her to have an abortion,or else accept full responsibility for the child? Why is it right for her to say okay, oops, but now your life is ruined because I refuse to abort this child or to let you off the hook?

And no, it's not breach of contract to say you don't want a child and say that if you get pregnant you'll abort, but then decide not to abort. That's been tested in the courts, and failed. The Court won't force her to get an abortion, and won't absolve the man of responsibility.

Further question: what if the man was raped? Answer: he's still responsible.
