I guess a closer analogy would be that you are allowing the deal to go down in your house with the agreement that no on premises use will occur.

Well, maybe if it were a one night stand with a bar fly, but in this case you are paying for a service that comes with some assurances on the part of the service provider. If you buy a ticket to ride on a roller coaster and the thing cracks up because the carnival operator left some bolts off; it doesn't matter if you were waiving your arms around like an idiot, the carnival operator is expected to cover you for your safety.
