Andreas: Maybe there are still licensing issues with Intel... If over time every motherboard "reactivates" SSE, AMD is technically not shipping CPUs with SSE support but it works anyway. Sounds stupid but maybe there's an Intel lawsuit looming. Or could there be another explanation for this?

Well, the legal issue would only be over the implementation, not the instruction set itself (although the name would be protected by trade marking). Even disabled, AMD is still shipping the implementation and, as such, would be liable if it infringed on Intel patents. Since the feature can be activated, there would seem to be no protection from such an infringement case.
