Ground Zero:

"The police are currently saying Condidit is not a suspect because they don't want to prejudice the case before they nail him....."

That is your opinion.

I take the police at their word. If they had proof that Mr. Condit committed the crime, he would be locked up right now and charged. That is, at least, the typical process when a person is a suspect and law enforcement has proof that an individual has committed a crime.

Without being charged with a crime, he can be asked questions without an attorney present and the rest of the Miranda rights. He doesn't have to answer and he is not under oath. The police can ask him anything they want. He doesn' have to answer or he can lie. But as soon as he is charged Miranda allows a big cone of silence without prejudice.
