All of A**man's argument is based on a clerical error in the filings that he did apparently did not bother to verify.

First of all, that was not all of Asensio's argument, it was all of Thermoview's argument that Asensio's research was flawed.

Second, so what you're saying is that Asensio should take the word of a tiny company (with, if he's right, a very checkered history), that is already at odds with him over his prior reports on REFR, over the official records of the Securities and Exchange Commission?

And even if the SEC records are wrong and Thermoview is right, doesn't THV bear any responsibility at all for failing to detect this error and have it corrected sometime in the past three-plus years?

Trading in ThermoView common stock commenced on April 16, 1998. Prior to April 15, 1998, ThermoView was a development stage corporation, and had no business operations since its incorporation.

I have no idea why you boldfaced this statement as it is completely irrelevant. It is the shell company ThermoView merged with that is in question here.

Jackal INC (now THV) came into being Dec 1, 1987 (7 months AFTER Jackal INDUSTRIES) and then became, in May of 1994, Oak Hill, and finally, on Feb 24, 1998, became Thermoview--which it was for almost 14 months BEFORE Jackal INDUSTRIES became First Capital. THV had not been known as Jackal for FOUR YEARS at that point.

Then riddle me this, Batman. If there's no relationship between these two companies, then why does a "company name" search for "Thermoview" on FreeEdgar turn up the symbol FCRS, that of First Capital Resources? Another clerical error?

Curiouser and curiouser... First Capital seems to be propagating that "clerical error" even to this day. From First Capital's most recent 10-Q, dated 5/15/01:
