The words right to privacy are not in the Constitution. As I recall it was a right that came out of a SC case on privacy. So what does that have to do with acitivism or political agenga?

You can refer to the historical documents on the Congressional arguments over whether the Federal government has the Constitutional authority to build "roads". I believe it was Patrick Henry that argued that building roads was not specifically in the US Constitution. So, would you say that there the Congress or the Court was exercising a political agenda when it [they] agreed to build federal roads?
